Motito Ltd. (referred to as "Motito", "we", "us", or "our") is a layaway and instalment payment service registered in Delaware with a subsidiary in Ghana, where we conduct our operations. We provide PaySmallSmall, a service that allows customers to pay for physical or tangible assets in instalments. This service is primarily available through our website at motito.co and our partner platforms.

At Motito, we are committed to protecting the privacy of our customers. This Privacy Policy explains how we collect, use, share, and retain personal information, as well as the rights and choices available to you regarding your personal information.

For this purpose, you waive your rights regarding the confidentiality of client information and expressly consent to the processing of any personal information and records relating to you that might be obtained from third parties, including government agencies, your employer, business associates, and other entities Motito may deem proper and sufficient in the conduct of your business, sensitive or otherwise, for the purpose of determining your eligibility for a plan for which you are applying.

If you decide to decline consent or revoke any permissions, the service will gracefully degrade its functionality, allowing you to continue using Motito with limited features. We are committed to ensuring a transparent and user-friendly consent process.

3. Scope of Policy

This Privacy Policy applies to your use of:

  1. The Motito website and any associated web applications ("Platform"), accessible at motito.co and shop.motito.co.
  2. Any of the services accessible through the Platform, including PaySmallSmall, Keep My Price, Pay4Me, and related features ("Services").

By accepting Motito's privacy terms, you agree to the collection, processing, and sharing of your personal information for legitimate business purposes, including but not limited to determining your eligibility for plans and services. We store personal information on servers hosted by Amazon Web Services (AWS) and take appropriate measures to protect the security of personal information stored on these servers, including implementing industry-standard security protocols and regularly monitoring for unauthorised access.

9. Data Retention

We retain personal information for as long as necessary to provide our services, comply with our legal obligations, and enforce our agreements. We will delete or anonymise personal information that is no longer needed for these purposes.

10. Data Deletion Requests

If you want us to delete your Motito account or any personal data we hold about you (including data collected through Motito PaySmallSmall, WhatsApp, Instagram, or other channels), please email hello@motito.co.

Include your full name, phone number, and any relevant details. Once we verify your identity, we will delete or anonymise your data unless we are required to keep certain records for legal or regulatory reasons.

11. Security

We take reasonable measures to protect personal information from loss, misuse, and unauthorised access, disclosure, alteration, and destruction. We use encryption, firewalls, and other security technologies and procedures to help protect personal information. We will not be liable for any damages arising from the use of our services or the loss of personal information, including but not limited to direct, indirect, incidental, special, consequential, or punitive damages, regardless of whether we were advised of the possibility of such damages. We will also not be liable for any damages resulting from the unauthorised access to or alteration of customers' transmissions or data, or any other matter relating to our services.

In no event shall our total liability to you for all damages exceed the amount of fees paid by you to us in the previous 12 months.

We may update this Privacy Policy from time to time. We will notify customers of any changes by posting the new Privacy Policy on our website.
